By accessing or using the Surge CRM application, you agree to be bound by these Terms. Surge provides specialized software for solar EPCs and dealers on a subscription basis. We grant you a limited, non-exclusive, non-transferable license to use the service for your internal business operations.
You agree not to misuse the service. This includes attempting to compromise our security, reverse-engineering the software, or utilizing the application for illegal activities. You are strictly responsible for the content, leads, and documents you process through your dedicated instance.
Upon registration, you are provided with a dedicated database instance. You are entirely responsible for maintaining the confidentiality of your administrator credentials and for all activities that occur under your account.
Surge operates on a best-effort uptime basis utilizing shared hosting infrastructure. While we strive for maximum reliability, we do not provide a guaranteed Service Level Agreement (SLA). We are not liable for business losses or damages resulting from temporary downtime, data unavailability, or connection issues.
We reserve the right to modify our subscription fees at any time. However, any price increases will only apply to existing subscribers after an advance notice period of [X days].
Subscriptions are billed in advance. You may cancel your subscription at any time; however, all payments are non-refundable. Upon cancellation, your dedicated instance and all associated data will be securely purged after a grace period of [X days] following the end of your billing cycle.
To the maximum extent permitted by applicable law, Surge's total aggregate liability for any claims arising out of or relating to these Terms or the use of our services shall be strictly limited to the total fees paid by you to Surge in the [X months] immediately preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages.
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of [your city], India.
